Welcome to Chez Shea Custom ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website www.chezsheacustom.com (the "Site"), as well as any purchases you make through the Site or our other sales channels. By accessing or using the Site, or by placing an order with us, you agree to be bound by these Terms. If you do not agree to all of these Terms, you must not use the Site or purchase our products.
Please read these Terms carefully, along with our Return Policy, Privacy Policy, and any other policies referenced here. We may update these Terms from time to time, and your continued use of the Site after changes constitutes acceptance of the revised Terms.

You must provide accurate, current, and complete information when creating or updating your account. We may suspend or terminate your account if any information is found to be inaccurate or if we suspect fraudulent activity.
3. Products, Pricing, and Orders
Product Descriptions: We strive to provide accurate descriptions, images, and pricing for our candles, wax melts, accessories, and other products. However, we do not warrant that product descriptions, colors, scents, or other content on the Site are accurate, complete, reliable, current, or error-free. Candles are handmade, so minor variations in appearance, color, or scent strength may occur.
Pricing: All prices are in U.S. dollars and are subject to change without notice. We reserve the right to correct any pricing errors, even after an order has been submitted. In the event of a pricing error, we may cancel the order and notify you.
Orders: By placing an order, you represent that you are of legal age to form a binding contract and that the information you provide is accurate. We reserve the right to limit or cancel quantities purchased per person, household, or order. We may refuse or cancel any order for reasons including suspected fraud, errors in pricing or product availability, or violations of these Terms.
All orders are subject to acceptance and availability. We will notify you if we cannot fulfill your order.
4. Shipping and Delivery
Shipping times and costs are estimated and may vary. We are not responsible for delays caused by shipping carriers, customs (for international orders), or unforeseen events. 5. Returns and Refunds
Our Return Policy governs all returns, refunds, and exchanges. Please review it on our dedicated Return Policy page before purchasing. In general, we do not accept returns on opened or burned candles due to hygiene and safety reasons, except in cases of damage, defect, or our shipping error.
6. Candle Safety and Usage
Candles are open-flame products and must be used with extreme care. Never leave a burning candle unattended. Always:
Burn candles on a heat-resistant, stable surface away from flammable materials, drafts, children, and pets.
Trim the wick to ¼ inch before each use.
Keep the wax pool free of debris.
Do not burn a candle for more than 4 hours at a time.
Discontinue use when ½ inch of wax remains.
We are not responsible for any injury, damage, or loss resulting from improper use, failure to follow safety instructions, or misuse of our products. By purchasing our candles, you acknowledge that you have read and will follow all safety guidelines provided with the product or on our Site.
Warning: Burning candles can cause fire, injury, or death. Use at your own risk.
7. Intellectual Property
All content on the Site, including text, images, logos, product names, scents, designs, and graphics, is the property of Chez Shea Candles or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from any Site content without our prior written consent.
8. Disclaimers and Limitation of Liability
The Site and all products are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, Chez Shea Candles shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our products, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the specific product in question.
We do not guarantee that the Site will be error-free, secure, or uninterrupted.
9. Indemnification
You agree to indemnify, defend, and hold harmless Chez Shea Candles its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of our products, or your violation of any law or third-party rights.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Palm Beach County/West Palm Beach, Florida

We reserve the right to modify or replace these Terms at any time. The most current version will be posted on the Site with an updated effective date. Your continued use of the Site after any changes constitutes acceptance of the new Terms.
